Overview
The Water Law course is intended to facilitate a comprehensive and critical engagement with the principles, policies, institutions and regulatory framework governing the management and use of raw water in South Africa. The themes of the course will include a strong transformation focus; the nexus between water, energy and food; environmental and social justice; ecological integrity and allocation of water resources. It will consider the constitutional obligations relating to the right to water and aims to stimulate a deeper awareness and understanding of these constitutional obligations and the entitlements to which they give rise. The course will incorporate a deep critical engagement with the concept of state custodianship of water and the obligations of the state to manage and protect this natural capital, including environmental and international obligations. The challenges in water management and the allocation of scarce water resources across sectors so as to optimise the use of water through better planning and incentives will be explored. This will include an analysis of the regulatory levers, licensing, pricing, ecological infrastructure and recognition of strategic water areas.
Duration
This is a block release course where participants attend evening lectures once a week from 17:30 to 19:00 during the period 10 February to 27 May 2025.
Format
Courses might be delivered through blended learning. Students are required to have basic computer skills and stable internet connection.
