Overview
This course delivers essential legal insight into the South African Law of Prospecting and Mining, focusing on both theoretical frameworks and practical legal application. Core content includes the acquisition and conversion of mineral rights, the Mining Charter and BEE compliance, administrative and constitutional issues (e.g. expropriation and compensation), mine health and safety, and surface and environmental rights. Students also explore unique forms of mining (e.g. petroleum, quarrying, offshore) and beneficiation regulation. Comparative legal issues from African jurisdictions are examined to contextualise South African mining law within a broader legal and political framework. Applicants without a law degree must complete an introductory legal course and demonstrate relevant legal work experience. A quality-assured certificate from the University of the Witwatersrand is issued on successful completion.
