Overview
The course aims to equip participants with sufficient knowledge of the main laws and legal principles applicable to retirement funds in South Africa, and the rights and obligations of their members and other beneficiaries, to enable them to engage meaningfully with some of the interesting legal issues that arise in the context of the relationships between them.
Duration
This is a semester-long course where participants attend evening lectures from 17:30 to 19:00 once a week during the period 10 February to 27 May 2025.
Format
Courses might be delivered through blended learning. Students are required to have basic computer skills and stable internet connection.

    The course content addresses the following topics:


    • Occupational retirement funding versus the provision of social welfare pensions, and the different forms of retirement funds;
    • Membership, rules, and what funds can and cannot do;
    • Contributions to funds;
    • Benefits on and after retirement, including spouses pension;
    • Benefits payable on termination of membership before retirement, on death before retirement and on permanent disablement before retirement;
    • Duties of the boards of retirement funds;
    • The splitting of retirement savings on divorce;
    • Deductions from retirement savings;
    • Protection of pension benefits against reduction, attachment etc, with specific reference to maintenance claims;
    • Rights of access to fund information, dispute resolution, and the enforcement of member's rights;
    • Tax treatment of benefits paid by pension and provident funds.
