Overview
This course builds on core environmental law principles by focusing on air quality and waste management within South Africa's NEMA-SEMA statutory framework as covered in Environmental Law and Sustainability II. Students critically examine regulatory tools, enforcement mechanisms, and the extent to which environmental legislation advances constitutional rights under Section 24. Topics include pollution control, emission standards, priority air quality areas, waste regulation, liability for pollution, contaminated land, waste reclaimers, and extended producer responsibility. Case studies, such as the Cornubia chemical plant fire, situate legal frameworks in real-world contexts. Designed for legal professionals, the course deepens understanding of enforcement challenges and the socio-political context of environmental governance. A quality-assured certificate from the University of the Witwatersrand is issued on successful completion.
